TERMS OF SERVICE
These Terms of Service (“Terms”) govern the packages and/or services provided by Tiffany Hardy (the “Services”). By making a payment, you agree to be bound by the terms and conditions set forth in these Terms. If you do not agree to be bound by these Terms, please do not proceed with the services. These Terms shall not be modified unless in writing mutually agreed and signed by Tiffany Hardy. Unless otherwise stated herein, all payments are final.
SPECIFIC TO WRITING SERVICES:
Services / Work Authorization: Full payment in advance constitute authorization for Tiffany Hardy to commence work for the Services and to retain your spot on Tiffany Hardy’s production calendar. The nature of the Services provided (and required payment relating thereto) shall be agreed upon prior to Tiffany Hardy’s performance of Services. You shall prepay all Services prior to Tiffany Hardy’s performance and/or completion thereof. Any agreement for additional Services shall be set forth in writing prior to Tiffany Hardy’s performance of any such Services. Should additional Services be requested in addition to the Services, you agree to pay for such additional and/or a la carte Services pursuant to the set cost(s) made known by Tiffany Hardy prior to Tiffany Hardy’s performance of any such Services.
Deliverables: Upon complete payment and Tiffany Hardy’s completion of Services, Tiffany Hardy will provide you certain deliverables (dependent on the Services requested) including, but no limited to, MS Word and PDF files for the Resumes, Executive Bio, Networking Brief, Letters, and References Sheet. A Plain Text file for the Executive Resume will also be provided (text only). The LinkedIn Profile content will be provided in Word format and will be adapted from the resume. This content includes the following LinkedIn sections: Headline, About, Experience, and Skills. At no point will Tiffany Hardy access the your private LinkedIn account, but rather will provide content to be copy-and-pasted and guidance will be offered on settings adjustments within the platform (via the LinkedIn Guidebook).
Completion of a questionnaire and 2-hour interview is a requirement of the resume or LinkedIn profile development project. You agree to complete the questionnaire thoroughly and deliver it at least one week prior to the 2-hour interview, which will be scheduled based on mutual agreement. Project success is dependent upon this extended lead time. If you do not deliver the questionnaire on time or otherwise need to reschedule, the 2-hour interview will automatically be cancelled and postponed to the next available slot on the production calendar by mutual agreement (typically up to 4-6 weeks out). If you require rescheduling/postponement a second time, rescheduling to the next available spot will only being permitted upon completion and delivery of the questionnaire.
Project Scheduling & Questionnaire Completion: Project scheduling is finalized only upon payment and no calendar spots are guaranteed until payment has been received.
No Cancellation by Client: Since Tiffany Hardy blocks off significant amounts of time on Tiffany Hardy’s calendar to dedicate time to perform the Services, fees are understood as non-refundable retainers for Tiffany Hardy’s performance of Services and shall not be returned.
Timeline for Receipt of Drafts: The first resume proof will be provided within 5-10 business days after the interview has finalized. The precise date of delivery of the final draft is dependent upon the extent of the revision required and your acceptance of the finalized draft. Any subsequent drafts after the first draft will be delivered to you within 4–5 business days of Tiffany Hardy’s receipt of feedback.
Revision Policy: Writing projects begin with one core service (resume or LinkedIn profile development). Any additional items in the package are developed only upon your acceptance of the finalized initial core document.
You agree to schedule a feedback call or provide any feedback and/or requests for modification via email within 10 days of receipt of any draft (the “Review Period”). Failure to provide feedback within this timeframe constitutes full acceptance of the draft in question as the final version. You agree that any work required on the document after this point, including edits or discussion sessions, will be subject to an hourly fee of $250 charged in 1-hour (minimum) increments.
You agree that any changes in career objective or the addition of any new information to be incorporated into the documents once the interview has finalized constitutes a mid-project change of scope and thus additional fees may be incurred (at an hourly rate of $250 with a minimum fee of 1 hour charged).
It is your responsibility to review the documents carefully and provide all feedback on the initial draft within the Review Period. Tiffany Hardy will develop and deliver as many draft iterations are necessary to reach 100% satisfaction. However, multiple draft iterations are required only if the initial requested modifications have not been implemented to your full satisfaction. You agree that substantial modifications to strategy, content, and/or design and layout that should have been communicated with the initial feedback on the first draft but were not raised until subsequent drafts will be subject to a $250 hourly fee (with a minimum of 1 hour charged).
Accuracy of Deliverables: Although great care is taken to ensure the document is 100% error-free (with initial drafts being quality checked by a professional proof-reader and all drafts being proofread multiple times by Tiffany Hardy), all proofreading remains your sole responsibility. Furthermore, you are 100% responsible for the accuracy of the content of all documents, and for ensuring compliance with any agreements they you have with your current or former employers in the disclosure of information.
Optional publishing authorization: You grant permission for the content of career documents to be published in books or other career industry-related publications, or submitted for career-industry award competitions at the discretion of Tiffany Hardy and with the understanding that ALL IDENTIFYING INFORMATION (name, address, names of employer, etc.) WILL BE FICTIONALIZED to protect your confidentiality. You may opt out of this by emailing Tiffany Hardy at firstname.lastname@example.org.
Editing Authorization: You grant permission for the deliverables to be given a final quality check by a 3 rd party editor/proof-reader.
SPECIFIC TO RESUME DISTRIBUTION SERVICES
Description of Coaching Services: Coaching Services include a personally adapted and creative process whereby Tiffany Hardy will offer guidance to inspire you to take action to improve your professional potential. It is designed to guide you to carry out your own actions to achieve your goals.
Coaching Cancellation / Rescheduling Policy: You agree to notify Tiffany Hardy 24 hours in advance for rescheduling. If less than 24 hours is given, Tiffany Hardy reserves the right to apply payment made in advance to the missed meeting with no guarantee of rescheduling or refunding.
Questionnaire & Coaching Refunds: You agree to deliver a questionnaire prior to scheduling the first coaching session, if Tiffany Hardy requires it. Once Tiffany Hardy receives the questionnaire, pre-session work will have commenced and no refunds on the Coaching Service will be provided.
SPECIFIC TO LINKEDIN AUDITING SERVICES
Overview & Deliverables: The LinkedIn Audit Services are meant to guide you in optimizing your LinkedIn profile to achieve your professional goals with a “do-it-yourself” approach. It consists of Tiffany Hardy providing a critique of your core LinkedIn profile sections (Visual imagery, Headline, About, Experience, Skills) delivered as a video file, a written action plan/to-do list, a LinkedIn guidebook to steer content creation, settings, and activity, and a 60-minute follow-up coaching session to review changes and for Q&A.
Questionnaire & LinkedIn Audit Refunds: You agree to deliver a questionnaire before work may commence on the LinkedIn Audit. Once Tiffany Hardy receives the questionnaire, work will commence and no refunds on the LinkedIn Audit Services will be provided.
Timeline for deliverables: Upon purchasing a LinkedIn Audit Service and delivering the questionnaire, Tiffany Hardy agrees to deliver the LinkedIn Audit deliverables within 10 business days although she reserves the right to extend this deadline due to a Force Majeure Event.
Unused Services/portions of package: Should you fail to use portions of a package provided in accordance with the Services within 12 months of purchase, no refunds or credits of any kind will be given.
Client’s Responsibility for Job Search Outcome: Since job search success depends on a wide variety of factors that go beyond written career documents including, but not limited to, your ability to tailor the documents properly to each opportunity, your ability to secure referrals for positions, your ability to outperform other candidates during interviews, and a myriad of additional factors including the profiles of other candidates against whom your are competing and/or macroeconomic conditions, you agree to accept full responsibility for the outcome of your own job search.
Waiver/Limitation of Liability: You acknowledge that the Services provided are guidance / advisory services only; in no event shall Tiffany Hardy’s providing of Services be interpreted or construed as providing any guarantees or “definites” regarding such Services, and you acknowledge that any and all acceptance of guidance and/or advice provided shall be subject to your sole and absolute discretion on a case by case basis. You are wholly responsible for actions or inactions or for any direct or indirect results of any coaching and/or other Services provided or advice received. In no event shall it be construed that Tiffany Hardy enticed or induced you to act in a manner in which you would not have done absent the providing of such guidance or advice by Tiffany Hardy. It shall be the your sole responsibility to evaluate and act upon the information provided by Tiffany Hardy. During all stages of document development and revision, Tiffany Hardy will counsel and implement industry best standards in its performance of Services. If you request changes that conflict with said best practices, Tiffany Hardy will advise accordingly, but waives any and all responsibility if changes are made that conflict with the advice provided.
Your use of the Services is solely at your own risk. The Services, including, without limitation, any materials or content provided in relation thereto, are provided “AS IS,” without warranty of any kind, either express or implied, including, without limitation, any warranty for information, data, availability, completeness, accuracy, usefulness, merchantability, or fitness for a particular use, and any and all other warranties are expressly disclaimed by Tiffany Hardy to the fullest extent of the law. No information, whether oral or written, obtained from you for or through use of the Services shall create any warranty not expressly made herein. Notwithstanding the foregoing, Tiffany Hardy attempts to ensure that all information provided via the Services is correct, and Tiffany Hardy reserves all right to change, proof, or edit any information provided via the Services in accordance with these Terms. It shall be your sole responsibility to evaluate and act upon the information provided via the Services.
IN NO EVENT SHALL TIFFANY HARDY BE RESPONSIBLE FOR ANY CONSEQUENTIAL, SPECIAL, INCIDENTAL, PUNITIVE OR OTHER INDIRECT DAMAGES, INCLUDING, WITHOUT LIMITATION, LOST REVENUE, BUSINESS, OR PROFITS, IN ANY WAY ARISING OUT OF OR RELATING TO TIFFANY HARDY’S PERFORMANCE OF SERVICES (WHETHER IN CONTRACT, TORT, OR OTHERWISE) EVEN IF TIFFANY HARDY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL TIFFANY HARDY’S AGGREGATE LIABILITY EXCEED THE AMOUNT OF MONIES THEN RECEIVED BY TIFFANY HARDY FROM A CLIENT PURSUANT TO ITS PERFORMANCE OF SERVICES FOR SUCH CLIENT.
Indemnification: You agree to at all times defend, indemnify, and hold harmless Tiffany Hardy, and Tiffany Hardy’s officers, directors, shareholders, employees, attorneys, agents, affiliates, successors, and assigns, from and against any and all third party claims, damages, liabilities, costs, and expenses, including, without limitation, reasonable attorney’s fees and costs, arising out of or relating to: (i) your breach of this Agreement; (ii) Tiffany Hardy’s use of your personal and/or confidential information in accordance with or in furtherance of the Services; (iii) your use of the Services (including, but not limited to, deliverables) in a manner not intended, directed, or advised by Tiffany Hardy; and/or (iv) any materials that you provides in furtherance of the Services.
Force Majeure: Tiffany Hardy reserves the right to extend any deadlines due to unforeseen circumstances including illness, natural disasters, global pandemics, family or personal emergencies, technical failure or shutdown (i.e. hardware or software failure) and/or any other causes beyond Tiffany Hardy’s reasonable control (each a “Force Majeure Event”). Upon the occurrence of a Force Majeure Event, the time for performance of Services shall be extended for the period of time in which the Force Majeure Event was in existence; provided, however, in the event a Force Majeure Event remains in existence for a period of more than sixty (60) consecutive days, either party may terminate the Services upon providing written notice. In the event of termination hereunder: (i) you shall pay to Tiffany Hardy all amounts due and payable to for Services (and any additional and/or a la carte services required or requested) performed up to the cancellation date (if not previously paid); and (ii) you acknowledge that any and all compensation already paid is non-refundable.
Relationship of the Parties: Tiffany Hardy is retained solely as an independent contractor, and nothing contained herein shall be construed or interpreted as creating an agency, joint venture, partnership, or employment relationship of any kind. Tiffany Hardy shall have the absolute right to control the means, manner, and method by which Tiffany Hardy provides the Services.
Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to conflict of law principles thereof. You agree that binding arbitration before a single arbitrator shall resolve any dispute or controversy arising in connection with this Agreement. Any such arbitration shall be conducted in Phoenix, Arizona. Judgment upon any award may be entered in any court of competent jurisdiction. The decision of the arbitrator shall be binding and conclusive. In the event of any legal action or proceeding brought for the enforcement of these Terms or arbitration award, the prevailing party shall be entitled to recover reasonably incurred attorney’s fees and costs.
